Hello All:

        For so long as wireless carriers still provide
telecommunications services, the FCC still has Title II common carrier
regulatory authority.  The Commission can require Truth in Billing
including a requirement for carriers to inform subscribers of
overages.  It would take a bogus leap of faith to assume that because
wireless carrier also offer information services the First Amendment
trumps lawful Title II economic/public interest rules.  I don't see
this one as a close call.
