"Regulating Google results would violate First Amendment"

http://j.mp/IOoDoj (ars technica) [article]

http://j.mp/IOoBNd (volokh) [paper / PDF]

"A prominent First Amendment scholar has co-authored a white paper
arguing that search engines enjoy the same high level of First
Amendment protections as traditional media outlets. Google
commissioned the paper, presumably to help ward off calls for
government regulation of its search results."

The paper's analysis is correct. And especially to the critics in the
audience, I'll note that this fact is true regardless of the paper's
funding source.
