maybe we can nail the offending ISPs this way: either they are common carriers, and required to pass all payload bits unchanged; or they are not common carrier and thus responsible for ALL illegal content that passes through their wires.

can't have it both ways.

[ Brett, Joshua specifically said *content*. The issue is changing what's inside the truck without the permission of the shipper or final addressee, not the changing of tires or other truck parts along the road as necessary to reach the final destination.

modify the content of what they are transporting.  Imagine if other
industries did something similar.  Think about a trucking company
modifying every piece of freight on one of their trucks.  No body
would argue that those actions were acceptable.
